California police misuse legal process

On the month of December 17th 2019 the former mayor Rob Stanley Schroeder and the city of Martinez through John Allan Abaci state bar license #166493 represented by Colantuono, Highsmith & Whatley who are government attorney abused the judicial process by issuing a work place violence restraining order against Elijah Dominguez who had been known for sending correspondence to the City of Martinez and attending city council meeting where the city of Martinez was involved in violation of free speech

The city of Martinez on page two of the work place violence restraining order stated that the respondent make frequent complaint about the city and question the city legal authority at city council meeting presided over by the mayor & through correspondence

On page two it shows clearly that the city of Martinez was had motive because the mayor Rob Stanley Schroeder authority was challenged by Elijah Dominguez and that the city of Martinez misused the legal process to abuse power of authority of there office

The city of Martinez said the respondent physical assaulted the mayor Rob Stanley Schroeder while he insisted he was placing him under arrest. When police arrived he was physical injured Police officer by biting his finger

What the complaint doesn't not tell you is about the investigation that was under taken by Mr. Dominguez in regards to the Martinez police officer association Registered to the secretary of state of California entity number (727207) and the Martinez police non-sworn employees association secretary of state filing number (1801681) where the city of Martinez

Both the Martinez Police officer association and Martinez Police non-sworn employees association where both entity were suspended the Martinez Police non-sworn employees 6/7/2001 franchise tax board suspended Control ID

LBA9607105 and the franchise tax board (FTB)Suspended Control ID LBA9607107 on 10/1/2014

Now after complaint against the City counsel on July 2nd 2019 and the city of Martinez refusal to investigate misconduct which had lead to a citizen arrest pursuant to California penal 834& 837

California penal code 843 says An arrest is taking a person into custody, in a case and in the manner authorized by law. An arrest may be made by a peace officer or by a private person

So I had to physical take Rob Stanley Schroeder in custody An arrest is made by an actual restraint of the person, or by submission to the custody of an officer. The person arrested may be subjected to such restraint as is reasonable for his arrest and detention California Code, Penal Code - PEN § 835

Elijah Dominguez had physical taken the former mayor Rob Stanley Schroeder into custody If a person has knowledge, or by the exercise of reasonable care, should have knowledge, that he is being arrested by a peace officer, it is the duty of such person to refrain from using force or any weapon to resist such arrest California Code, PEN § 834a

The law allows pursuant California Code, Penal Code - PEN § 837

A private person may arrest another:

1. For a public offense committed or attempted in his presence.

2. When the person arrested has committed a felony, although not in his presence.

3. When a felony has been in fact committed, and he has reasonable cause for believing the person arrested to have committed it.

The mayor Rob Stanley Schroeder for fraud after The City of Martinez’s refusal to honor a legally binding settlement with a Contra Costa County real estate developer costing taxpayers more than $35 million in damages, forcing the City into bankruptcy.

On December 4th 2019 Elijah Dominguez had done a public information request act requesting request the oath of officers of all Martinez Police Department be given there was 25 oaths of office and there was no record of Rocco lucido or sgt Steven gaul according to California Constitution art XX § 3 and in violation of CAlifornia Codes (gov 1360-1369)

The city of Martinez and sgt Steven gaul and Rocco Lucido we're acting as law enforcement officer but acting as agent to cover up the misconduct of law enforcement and false imprisoning a innocent man and this was to cover up the fact that the city has sought to commit fraud and silence Free speech and the city acted as a tyrant against speaking up against the City of Martinez
